Breaking Down the New Hemp Bill and What it Means for You

 Ever since the New Federal Farm Bill was passed last year, there have been a lot of questions about what it will do and what it means for the average consumer. Here’s the quick run down of what this means and how it’s going to affect the sale of cannabis going forward. 

Changing How “Hemp” is Defined

The 2018 Farm Bill legalized hemp by defining it as cannabis containing no more than 0.3% Delta-9 THC by dry weight. 

This allowed for a massive market of hemp-derived cannabinoids, including Delta-8, Delta-10, and THC-A products, that were federally legal but intoxicating.

The New Farm Bill contains related language that aims to close that loophole.

Now Hemp will be evaluated based on total THC, not just Delta-9. This means that many products that used to be considered Hemp, will no longer have that classification, even if they are Hemp-derived.

Products That Will Be Affected and How it Affects the Consumer

The products that will be most impacted by this bill are products that mostly contain Delta-8, Delta-10, and  THC-A. If these products will no longer meet the federal definition of hemp and will be classified as controlled substances. 

This means that online businesses, gas stations, liquor stores, and other businesses that carried these products because they didn’t need a license to sell them, will no longer be able to. 

This means that if someone was getting their products solely from these types of places, they will need to move to purchasing their THC products from a licensed dispensary. 

Important Note: State licensed dispensaries and the products that they sell will remain almost completely unaffected by this law. 

Why is This Better For the Consumer

Because these products and these businesses fell into a legal gray area, most if not all of the products were not subjected to the standard regulations and testing that all cannabis products must undergo. 

This means that at best consumers could be getting an unsatisfactory product or at worst could be consuming something that is dangerous to them. Without the constant testing and inspections that occur at state licensed dispensaries and grow facilities consumers are never sure if they are getting what is advertised. 

When Do These Changes Take Effect?

There is no exact date that these changes will go into effect but estimates suggest that it could be as early as late 2026. This will allow for a transition period for everyone, businesses and consumers alike, to adapt to these new regulations. 

However things are still up in the air and this bill may be delayed for months or even years and politicians and industry leaders continue to work on it.

With the start of the New Year, many people chose to participate in “Dry January” where they abstain from alcohol for the entire month. What’s going to happen to my weed? What Cannabis Rescheduling means for the consumer

On December 18, 2025, the President issued an executive order ordering the Attorney General to expedite the process of rescheduling cannabis from a Schedule I drug to a Schedule III drug. This process has been underway for the past two years and signals a massive shift in the way that people will view cannabis in the foreseeable future.

However, the rescheduling has brought with it a lot of questions from users and non-users alike. Asking what rescheduling means for them, for the industry and, more importantly for their product.

As your source of all things cannabis we’re here to try and answer those questions and help you understand and navigate this process.

What are Schedule I and Schedule III drugs and why was Cannabis re-scheduled?

All drugs in the United States are classified by the Drug Enforcement Administration (DEA) into one of 5 categories based on the drugs accepted medical use and its potential for dependency or abuse. 

A Schedule I drug is defined as a drug with no acceptable medical use and a high potential for dependency or abuse. Some Schedule I drugs are heroin, LSD, and ecstasy. 

A Schedule III drug is one that has medically accepted uses as well as moderate to low potential for dependency for abuse. ketamine, anabolic steroids, and testosterone are all defined as Schedule III.

Cannabis was recommended for rescheduling after the Food and Drug Administration (FDA) found scientific support for its use in treatment of pain, nausea, vomiting and more. 

**It’s important to note that the December 18th executive order does not officially reschedule cannabis, only orders the attorney general to speed up the process. As of publishing, Cannabis is still classified as a Schedule I substance.

Will this affect me as a consumer?

The short answer is no, cannabis rescheduling should not affect the consumer. It should not change the consumer access to their product and it shouldn’t change the price either. 

This change will ultimately affect the dispensaries, brands, and pharmaceutical research organizations. This will affect dispensaries and brands in the way that they are taxed. Rescheduling will also allow a lot more opportunities for clinical and pharmaceutical research into the effects of cannabis. 

Does this mean that weed is federally legal?

Unfortunately, no. Rescheduling does not make cannabis legal on a federal level. All of the state laws that are currently in place still apply.

What does this mean for people imprisoned for Schedule I Drug Possession?

It’s unclear. There are currently tens of thousands of people who are currently incarcerated for cannabis related offences, many of them have convictions related to possession of a Schedule I substance. While rescheduling is not decriminalization, it does beg the question, should those who are convicted of possession of cannabis as a Schedule I drug have their cases reassessed in the wake of the DEAs reassessment of cannabis.

If this is something that you feel strongly about, there are organizations like The Last Prisoner Project and NORML that are working towards prison and legislative reform in the cannabis space.

How will this affect the cannabis industry in the future?

Rescheduling helps to destigmatize cannabis and showcase to the general public all of the medical benefits of this amazing plant. More studies and research will only help improve our understanding of cannabis and all of the different ways that it can be used.

Additionally, the hope is that this is one more step towards federal legalization in the United States. Anything that can help change public opinion is another step towards changing policy.

Why Proper Storage Matters

When cannabis is exposed to the wrong conditions, several things can happen:

  • Loss of potency: THC and other cannabinoids degrade over time, especially when exposed to heat or light.
  • Loss of flavor: Terpenes, the compounds responsible for cannabis’s aroma and taste, evaporate if not stored properly.

The good news? There are plenty of ways to reduce, reuse, and recycle cannabis packaging, and they’re easier than you might think.

  1. Reduce Packaging Waste Before You Buy

The most effective way to cut down on waste is to choose products with minimal or eco-friendly packaging. While regulations can limit how simple packaging can be, many cannabis brands are making conscious efforts to be more sustainable.

  • Check the recycling symbol: Plastic containers labeled with a #1 or #2 are widely accepted by recycling facilities. Other types, like #5 or mixed plastics, may require special drop-off points.

     

  • Separate materials: Many cannabis packages have multiple layers—plastic lids, glass jars, and paper labels. To recycle properly, remove lids from jars, peel off paper labels if possible, and separate different materials.

     

  • Rinse before recycling: Residue from cannabis products can contaminate recycling loads. Give containers a quick wash before tossing them in the bin.

     

  • Participate in recycling programs: Some dispensaries and cannabis brands offer take-back programs where customers can return empty containers for proper recycling or reuse.
